Associate Counsel – Employment and Litigation

Responsibilities
Providing pragmatic, risk-adjusted advice to internal stakeholders on employment law related matters, including performance management, terminations, discrimination, harassment, accommodations, benefits, incentive plans, welfare plans, retirement plans, leaves of absence, employee investigations, and restructuring plans.
Oversee the drafting and negotiation of offer letters and employment-related agreements, including severance, separation, restrictive covenant, retention, and other employment-related agreements.
Support collective bargaining and labor contract drafting, administration, and interpretation.
Monitoring new laws, regulations and decisions affecting the substantive legal areas above and provide strategic, preventative advice to HR and cross functional partners.
Support employment-related aspects of mergers, acquisitions, strategic investments, and divestitures, including due diligence and related integration efforts.
Working closely with and supporting HCL’s team members responsible for employment and litigation compliance to develop and implement litigation management processes, procedures and policies (pre-litigation through trial).
Managing complex employment litigation through all phases, including personally handling early resolution negotiations, personally handling contested matters pending before federal/state governmental entities such as the EEOC and Departments of Labor, coordinating discovery, and providing strategic direction to and close supervision of outside counsel.
Draft and review pre-litigation and litigation documents, including correspondence with opposing counsel, pleadings, and mediation/arbitration statements.
Manage all aspects of our litigation/matter management system, compiling records and responsive information to subpoenas and other discovery, and managing and developing processes for our records database.
Ensure compliance with reporting and litigation hold obligations.

Required
J.D. from an ABA accredited law school (or foreign equivalent)
Licensed (in good standing) to practice law in at least one State
5+ years employment law and litigation experience, with a law firm or in-house, or a mix
Ability to partner with HR and other professionals across multiple regions to assess quickly the latest situations and develop practical options to respond to and resolve risks
Fluency translating legal advice into practical, risk adjusted, business-oriented advice
Ability and desire to support international business operations on complex legal issues and in new global regions as we continue to expand
Ability to work flexible hours with team members in India and across the globe
Excellent judgment, written and communication skills, with a strong attention to detail, ability to adapt quickly (especially where remote communication is a key element for supporting organizational needs) and to prioritize and manage workloads to meet deadlines
Reliable and collaborative team-player with a growth mindset, flexibility (especially in a remote atmosphere) and desire to learn and have a meaningful internal impact
Flexibility to assist the legal department in its other activities and its mission as needs arise
Ability to implement and perform pre-litigation procedures and oversee litigation effort including the selection and direction of outside counsel
