Responsibilities

Advise boards of trustees and fund administrators on compliance with ERISA, the Internal Revenue Code, DOL, PBGC, and IRS regulations
Counsel funds on withdrawal liability assessments and collections, funding issues, mergers, and restructuring
Draft and negotiate plan documents, trust agreements, collection policies, rehabilitation/ funding improvement plans, and settlement agreements
Represent funds in arbitrations, mediations, and litigation involving withdrawal liability, contribution delinquencies, and fiduciary matters
Provide training and guidance to trustees regarding their fiduciary responsibilities and governance best practices
Monitor regulatory and case law developments impacting multiemployer plans and proactively advise clients on risk mitigation strategies

Required

J.D. from an accredited law school and admission to practice in good standing in at least one U.S. jurisdiction
3-5+ years of relevant ERISA/employee benefits experience, with an emphasis on multiemployer benefit funds and withdrawal liability
Strong legal research, writing, and oral advocacy skills
Ability to manage complex projects independently and as part of a team

Preferred

Prior experience on either the Fund or employer side OK
Deep knowledge of ERISA and related laws, with a particular focus on fund contribution audits, withdrawal liability and related arbitration and litigation
Transactional experience a plus
