The New York State Department of Health is dedicated to ensuring public health and safety. They are seeking qualified attorneys to represent the Department in administrative hearings and manage legal documentation related to the prosecution of professional misconduct among healthcare licensees.

Responsibilities
Represent the Department in administrative hearings related to the prosecution of physicians, physician assistants and other licensees for professional misconduct
Draft appeal briefs in matters before the Administrative Review Board
Prepare Statements of Charges, Notices of Hearing, Subpoenas, Post-hearing submissions, and other legal documents
Review Investigative materials, interview and prepare lay and expert witnesses for hearings, and analyze and develop evidence for proceedings and disciplinary hearings
Draft and negotiate Consent Agreements, Surrenders, Non-Disciplinary Orders, Summary Suspensions, and other documents related to case resolution
Conduct legal research and draft legal memoranda
Provide legal and practical advice and recommendations to OPMC executive, investigative, and administrative staff
Prioritize cases, manage caseload, and promptly document entries in Hearing Tracker
Interact with staff from other Federal, State and City governmental agencies
Qualification
Required
Current NYS Department of Health (DOH) employee with permanent or contingent permanent status as an Assistant Attorney 1, NS, Assistant Attorney 2, NS, Assistant Attorney 3, NS or Senior Attorney, G-25
Current NYS employee with one year of permanent or contingent permanent competitive service in a title eligible for transfer under Section 70.1 of the Civil Service Law
Assistant Attorney 1, NS: Law school graduation and/or eligibility for NYS Bar Admission
Assistant Attorney 2, NS: Admission to NYS Bar
Assistant Attorney 3, NS: 12 months as an Assistant Attorney 2, or Admission to the NYS Bar and 12 months of subsequent satisfactory legal experience
Senior Attorney, Grade 25: 12 months as an Assistant Attorney 3, or Admission to the NYS Bar and 24 months of subsequent satisfactory legal experience
Admission to the New York State Bar and current registration to practice law in New York State is required for continued employment
Disbarment or loss of registration shall result in termination or suspension of employment

Excellent oral and written communication skills
Ability to work in a fast-paced legal environment
Ability to work as a member of a team
Criminal or civil trial experience or administrative hearing experience
