Responsibilities
Provides general legal guidance to the Mayor, City Council, department heads, and City committees and boards, which includes preparing a variety of legal documents; serves in the City Attorneys absence including, but not limited to, making presentations and providing legal advice during department meetings and various committee meetings (such as Finance and Administration Committee meetings) and supervising office administration within the Legal Department including, but not limited to, the litigation-related duties and other functions performed by the Legal Executive Assistant
Serves as supervisor/ chief of the Litigation Section within the Citys Legal Department; confers with and, as necessary, advises outside counsel concerning litigation strategy; supervises and mentors in-house staff attorneys concerning litigation, drafting legislation, examination and drafting of contracts and other instruments, and drafting departmental policies; and prepares cases for hearings and trials
Represents the City in litigation proceedings in court, which includes determining procedural avenues for actions; attending depositions; making strategic and tactical litigation decisions; and/or performing related activities
Reviews contracts, deeds, bonds, ordinances, and resolutions to verify appropriateness of terms, conditions, and applicable clauses
Serves as supervisor/ chief of Real Property Section of the Citys Legal Department and, as such, performs and examines abstractor and title search reports, evaluates economic feasibility of obtaining title insurance and performs additional services relating to real estate closings including, but not limited to, preparation of deeds, easement agreements and instruments of release; supervises the evaluation of City liens against real property including, but not limited to, liens arising from abatement of overgrown vegetation, debris and unsafe structures
Prepares and files legal pleadings, motions, briefs, and related documents
Performs other duties of a similar nature or level
Qualification
Required
Juris Doctorate from an American Bar Association accredited school of law
Four (4) years of experience as a practicing attorney, with significant civil litigation (federal and state) experience during those years
Tennessee State Law License
Knowledge of legal theory
Knowledge of applicable Federal, State, and local laws, rules, regulations, codes, and/or statutes
Knowledge of contract management principles and practices including knowledge of real estate law and real estate transactions
Knowledge of court procedures
Knowledge of the criminal justice system
Knowledge of interview methods and techniques
Knowledge of research methods
Knowledge of legal document preparation techniques
Knowledge of computers and related software applications
Skill in interpreting and applying applicable laws, rules, and regulations
Skill in providing sound legal advice
Skill in analyzing complex information
Skill in conducting legal research
Skill in preparing legal documents
Skill in applying legal principles to determinations on individual cases and problems
Skill in trying cases in court
Skill in analyzing, appraising, and organizing facts, evidence, and precedents relevant to assigned cases
Skill in using computers and related software applications
Skill in communication and interpersonal skills as applied to interaction with subordinates, coworkers, supervisor, the public, etc. sufficient to exchange or convey information and to receive work direction
Physical ability to perform sedentary work which requires exerting up to 10 pounds of force occasionally and/or negligible amount of force frequently or constantly to lift, carry, push, pull or otherwise move objects, including the human body
Ability to perceive attributes of objects, such as size, shape, temperature, or texture by touching with skin, particularly that of fingertips
Ability to pick, pinch, type, or otherwise work, primarily with fingers rather than with the whole hand as in handling
Ability to apply pressure to an object with the fingers and palm
Ability to perceive the nature of sounds at normal speaking levels with or without correction
Ability to receive detailed information through oral communication, and to make the discrimination sound
Ability to make rational decisions through sound logic and deductive processes
