Employee Benefits and ERISA attorney
JBA International is a leading law firm seeking an experienced Employee Benefits Attorney to advise on employee benefit programs. The role involves ensuring compliance with ERISA and related regulations while collaborating with various stakeholders to align benefit programs with organizational objectives.
Responsibilities
Provide legal counsel on employee benefit plans, including retirement plans (401(k), pension), health and welfare plans, and executive compensation arrangements
Ensure compliance with ERISA, the Internal Revenue Code, ACA, HIPAA, COBRA, and other applicable federal and state laws
Draft, review, and negotiate plan documents, summary plan descriptions (SPDs), policies, amendments, and participant communications
Advise on fiduciary duties, governance, and risk mitigation related to benefit plans
Support mergers, acquisitions, and corporate transactions by conducting benefits-related due diligence and integration planning
Respond to regulatory inquiries, audits, and investigations involving benefit plans
Manage relationships with outside counsel, plan administrators, insurers, and consultants
Monitor legal and regulatory developments affecting employee benefits and recommend proactive changes
Assist with benefits disputes, claims, and litigation as needed
Collaborate with HR and leadership on benefits strategy, design, and cost management initiatives
Qualification
Required
Juris Doctor (JD) from an accredited law school
Active license to practice law in California
3–8+ years of experience practicing employee benefits law
Strong working knowledge of ERISA, tax-qualified plans, and health and welfare benefit regulations
Excellent drafting, analytical, and problem-solving skills
Ability to communicate complex legal concepts clearly to non-legal stakeholders
Strong organizational skills and attention to detail
