Responsibilities

Take ownership of complex contract surety claims from initial investigation through resolution

Evaluate performance and payment bond exposures, develop and execute claim strategies, and determine appropriate performance options to protect the company’s financial interests

Conduct deep analysis of contracts and project circumstances, coordinate with principals, obligees, subcontractors, suppliers, consultants, and attorneys, and communicate clearly with internal partners

Provide legal guidance on contract language, risk assessment, and mitigation strategies to underwriting and business teams

Prepare internal analyses and reporting for large or high-exposure claims, establish and manage appropriate reserves, and proactively identify opportunities to reduce loss

Lead negotiations, represent the company in mediations and arbitrations, and help shape litigation strategies that align with both legal and business objectives

Draft and negotiate agreements, including takeover agreements, completion agreements, subcontractor ratification agreements, and other documents necessary to discharge bond obligations

Pursue salvage opportunities through indemnification and subrogation when appropriate, while managing loss adjustment expenses through oversight of outside counsel, consultants, and accountants
