General Attorney

The United States Patent and Trademark Office (USPTO) is seeking a General Attorney in the Office of the General Counsel, Office of the Solicitor, who will provide legal counsel on trademark and other intellectual property matters. The role involves representing the USPTO Director in courts, managing litigations, providing legal advice, and training USPTO employees on intellectual property topics.

Responsibilities

Providing legal counsel to the USPTO Director and Agency senior management on trademark and other intellectual property matters
Representing the USPTO Director in federal district courts and appellate courts, including defending decisions of the USPTO Director and the Trademark Trial and Appeal Board, preparing amicus briefs on behalf of the USPTO Director on issues of importance to the development of intellectual property law, and working with the Department of Justice to assist the Solicitor General in trademark and other intellectual property cases before the United States Supreme Court
Managing all aspects of litigations and appeals. You will be responsible for developing case strategy, drafting and responding to briefs and motions, drafting complaints, all aspects of discovery, taking and defending depositions, oral arguments, and conducting trials
Providing legal and policy advice to senior management and other offices within the Agency on trademark, copyright, ethics and disciplinary matters, including rulemaking, procedures, and proposed legislation. You will analyze legal and factual issues, develop the strategy to deal with these issues, and produce memos on the matter as needed
Handling trademark clearance and enforcement matters
Representing the Director at depositions and testimony of USPTO employees
Providing training to USPTO employees on a variety of intellectual-property related subjects
Performing various administrative tasks as assigned

Required

Four (4) years of professional law/legal experience, post J.D. and specialized experience including:
Primary drafting responsibility for briefs, complaints, motions, memos, and/or legal opinions in the area of trademark law
Independently conducting legal research and preparing written analyses of complex and difficult legal, factual, or policy issues in the area of trademark law
Professional Legal/Law Experience is defined as having experience including judicial clerkship(s), in the area of Trademark litigation. Trademark litigation includes federal district court trademark cases, trademark appeals to the U.S. federal courts of appeal, and trial proceedings before the Trademark Trial and Appeal Board
You must possess a Juris Doctor (J.D.) degree or Master of Laws (L.L.M) degree from an American Bar Association accredited law school and an active bar membership of any state
