Senior Director Subcontracts

Responsibilities
Assess 300+ subcontract relationships to determine where Cubic can leverage our spending to negotiate the best terms
Connect subcontract relationships across individual businesses to gain efficiency and reduce costs. Determine where there is redundancy, adjacencies and develop strategic footprint
Translate business segment strategy into functional plans and guides execution
Participate in the development and execution of subcontracts policies for the corporation
Participate in strategy development for the Integrated Supply Chain function
Lead the subcontracts management team and invest in their development and career progression
Direct the drafting, negotiating, and administration of subcontracts including amendments and addendums to ensure maximum benefit to the company. Subcontract types include DBOM, service agreements, hardware and software installation and maintenance agreements, supplier, consultant and contract labor, marketing, and banking agreements, etc
Direct competitive source selections, preparing solicitations and proposals; evaluation, negotiation, subcontract formation, administration, and closeout, all in accordance with appropriate company, operations department, and legal approvals
Monitor all subcontractor performance and progress to ensure compliance with all subcontract terms including schedule and delivery, scope of work, cost, legal, regulatory, contractual and company requirements. Manages the resolution of issues regarding performance, claims and changes and recommends termination when appropriate
Ensure internal stakeholders are informed Keep the Program Manager and cognizant functional managers informed of scope growth and other issues that may impact programs or prime contracts
Direct the negotiation of Non-Disclosure Agreements, Memoranda of Understanding, and similar agreements in support of subcontracts for execution in accordance with Company policies/approvals
Direct audits/reviews of subcontracts and manage subcontract payment administration activities
Ensure conformity to department policies and procedures
Remain current on legal/regulatory updates affecting contracts and agreements
Develop subcontract mitigation plans for key subcontracts to ensure program continuity
Assess Make vs Buy and provides pay-back justification for new or existing contracts
Analyze and manage excess material liabilities and ensure minimum business exposure
Present supplier audit reports to senior leadership, with recommendations and/or corrective action plans
Perform other related duties and special projects, as assigned by management
Qualification
Required
Bachelor's degree in business, legal or related discipline, plus a minimum of 15 years of progressive experience in commercial, federal, and local government contracts/subcontracts management and negotiation or master's degree or law degree plus 12 years related experience
Experience and knowledge of all types of contracts ranging in size from $200k to over $30M
Ability to handle multiple projects, high volume activity and establish priorities in a dynamic business environment
Thorough knowledge of prime/subcontract formation and administration activities and proven ability to negotiate terms, conditions, and price effectively
Must be able to manage multiple subcontracts, prioritize assignments and meet deadlines with minimal supervision or administrative support, and work extended hours, as required
Approximately 30% travel required
Preferred
Previous demonstrable success at introducing world class supply chain solutions using lean techniques
Experience in and knowledge of municipal, local government and the Federal Acquisition Regulations (FAR)
Experience in public transit and/or Defense subcontracts
