Responsibilities

Provide legal advice on all aspects of mortgage lending, including origination, servicing, secondary market transactions, and portfolio management

Interpret and ensure compliance with applicable federal, state, and local laws and regulations (e.g., TILA, RESPA, ECOA, FHA/VA, HMDA, FDCPA, CFPB rules, state mortgage laws)

Monitor regulatory developments and proactively advise leadership on impacts to business operations

Serve as primary legal contact for regulators, auditors, and examinations while collaborating with Tri Pointe Homes (parent company)

Advise senior leadership on legal risks, corporate governance, and regulatory matters

Develop and maintain policies, procedures, and internal controls to mitigate legal and compliance risks

Oversee dispute resolution, litigation strategy, and management of outside counsel

Lead legal responses to enforcement actions, complaints, subpoenas, and investigations

Review, draft, and negotiate contracts, including vendor agreements, loan purchase and sale agreements, servicing agreements, and technology contracts

Work with Capital Marketing and advise on product development, pricing, marketing, and advertising to ensure regulatory compliance

Partner with Compliance, Risk, and Operations teams to ensure consistent implementation of regulatory requirements

Support fair lending, consumer protection, and data privacy initiatives

Promote a culture of ethics, transparency, and compliance throughout the organization

Lead and develop the legal function, including internal legal staff and external counsel

Establish legal department priorities, budgets, and performance metrics

Provide training and guidance to business teams on legal and regulatory topics

Required

Juris Doctor (JD) from an accredited law school

Active license to practice law in Arizona

8+ years of legal experience in mortgage lending, financial services, or regulated banking environments

Significant experience advising on mortgage regulations, consumer finance laws, and regulatory examinations

Experience managing litigation and working with regulators and government agencies

Deep knowledge of mortgage and consumer finance laws and regulations

Strong business judgment with the ability to balance legal risk and commercial objectives

Excellent leadership, communication, and negotiation skills

Ability to operate in a fast-paced, highly regulated environment

High ethical standards and professional integrity

Preferred

Prior in-house counsel experience in a mortgage lender, servicer, bank, or financial institution strongly preferred

Experience with multi-state mortgage operations

Familiarity with secondary market agencies (Fannie Mae, Freddie Mac, Ginnie Mae)

Experience with Encompass, a plus
