Assistant City Prosecutor - Limited Duration
The City of Eugene is looking for an Assistant City Prosecutor, Limited Duration to assist with municipal violations and misdemeanor cases. This role involves representing the City in court, preparing criminal cases, and collaborating with various city departments.

Responsibilities
Serves as prosecutor on assigned cases and represents the City for city code and state statute offenses that are filed in the Eugene Municipal Court, including misdemeanor (traffic and ordinance), violations, probation violations, contempt hearings, trial status report sessions, and removals to the Circuit Court. This involves all jury cases, and non-jury cases where the defendant is represented by an attorney
Prepares and tries criminal cases for the City and conducts a variety of trial preparation and case work: reviews police reports; interviews witnesses and complainants to determine appropriateness of filing criminal charges; evaluates and files; provides discovery to defendants and attorneys; ensures that subpoenas are served to essential and relevant witnesses; ensures that required time lines are maintained
Negotiates with defendants and/or attorneys, and consults with involved officer(s) and victim(s)
Provides prosecution services at in- and out-of-custody arraignments and settlement conferences
Attends pretrial conferences with defendants, defense attorneys and judges; negotiates settlements
Assists with conducting specific and comprehensive analyses of a wide range of municipal court case issues; researching and drafting legal opinions and memoranda in response to defense motions; and initiating motions on behalf of the City
Proposes amendments or dismissals of complaints for good cause to the Court
Determines and recommends amounts and appropriateness of restitutions to be paid by defendants to victims; monitors compliance with ordered restitution payments
Works closely with the City Prosecutor, Deputy City Prosecutor, Court Administrator, Municipal Judges, and contracting attorneys; advises the Municipal Court of any changes in case status, including plea negotiations, dismissals or amendments
Monitors new developments in criminal case law and procedures and legislation
Participates in advising Eugene Police Dept personnel on questions involving criminal prosecution, such as evaluating sufficient evidence, advising on the basis for citing or arresting, and other issues related to criminal prosecution
Participates in court problem resolutions
Drafts and reviews court-related forms
Establishes and maintains effective communication with court staff, police, judges, and indigent defense counsel
May answer questions and provide information to the public regarding policy, procedure and case information
Assists with planning, organizing, and implementing alternative approaches to prosecution activities
Assists with the preparation of administrative reports on prosecution office activities
Compiles and submits victim assistance report
May be responsible for the selection, supervision and evaluation of assigned staff; assigns work and ensures appropriate training is provided; investigates complaints; recommends and administers disciplinary actions; handles sensitive personnel matter and recommends grievance responses; exercises full supervision over employees
Performs related duties as assigned
Qualification
Required
Two years of legal experience as an attorney, including at least six months courtroom experience in criminal law
Equivalent to a Juris Doctorate from an accredited law school
Must pass a police background investigation
Member of the Oregon State Bar at the time of hire
Preferred
Knowledge of principles and practices of criminal law and procedures
Knowledge of municipal court rules, policies, and procedures
Knowledge of city codes and state statutes, with emphasis on criminal law
Knowledge of principles and practices of investigation
Knowledge of principles and practices of negotiation and conflict resolution
Knowledge of judicial procedures and rules of evidence
Knowledge of principles and practices of municipal government budget preparation and administration
Knowledge of methods of legal research and reporting methods, techniques and procedures
Knowledge of principles of supervision, training and performance evaluation, if required
Knowledge of modern office procedures, methods, and computer equipment
Ability to follow established Eugene Municipal Court rules and policies
Ability to interpret and apply Federal, State, and City policies, procedures, laws and regulations
Ability to analyze, appraise, and organize facts, evidence, and precedents and present them in oral and written reports
Ability to analyze and understand applicable factual matters
Ability to properly interpret, evaluate and make decisions in accordance with the law
Ability to comply with all applicable victim's rights laws
Ability to conduct research on complex legal problems
Ability to exercise good judgment in case filing decisions and plea negotiations
Ability to work through issues in a cooperative manner
Ability to work in a fast-paced environment
Ability to prepare for trial on scheduled date
Ability to present cases in the courtroom skillfully
Ability to write complex legal papers and reports, setting forth findings of facts and decisions in concise written form

Ability to develop and apply creative program development and problem resolution as applicable
Benefits
Bilingual Pay Benefit: This position qualifies for up to an additional 5% of base salary for bilingual pay.
Non-Represented Retirement Program: Upon eligibility, the City will contribute an employee contribution of 6%, as well as the employer contribution, to a retirement program administered by the Oregon Public Employees’ Retirement System (PERS). In addition, the City will pay a 3% contribution to a deferred compensation program if the employee contributes at least 1%.
