Bankruptcy Specialist
Convergenz is a company focused on recovering bankrupt accounts, and they are seeking a Bankruptcy Accounts Specialist. This role is responsible for maximizing recovery through negotiation and legal proceedings, serving as a liaison with legal counsel, and providing specialized servicing of charged-off mortgage loans.
Responsibilities
Analyze accounts included in bankruptcy for potential abuse and/or fraud to determine if litigation is warranted to protect NFCU’s interests and reduce financial loss
Monitor attorneys assigned to accounts to determine litigation status and advise attorneys of legal issues and their impact on NFCU
Process and distribute time-sensitive legal documents, including notifications of suits against NFCU, Cease and Desist orders for both filers and non-filers, and third-party communications to ensure compliance with bankruptcy laws and minimize litigation risk
Review bankruptcy docket reports and analyze accompanying schedules, with emphasis on Statements of Intent for Chapter 7 and Plan information for Chapter 13, to determine impact on NFCU
Communicate with attorneys, trustees, members, agents, title companies, and internal and external third parties regarding bankruptcy matters
Negotiate attorney fees and recommend approval to the Supervisor
Analyze Chapter 7, 11, and 13 bankruptcy filings to determine potential for asset recovery
Initiate appropriate asset recovery actions based on collateral, cross-collateral potential, and non-filing parties in accordance with state repossession laws
Represent NFCU or retain outside legal counsel for court proceedings
Manage legal notifications such as Mechanic’s Liens, Adversary Complaints, Motions for Lift of Stay, Motions to Avoid Lien, Motions to Value, Judgment Liens, and Plan Confirmations, and determine the appropriate course of action
Negotiate short sale requests, settlements, and reaffirmations based on bankruptcy disposition
Process charged-off bankruptcy-impaired equity loans; facilitate Proofs of Claim and review motions
Monitor bankruptcy progression to ensure adherence to repayment plans and update NFCU systems for accurate reporting
Pursue fraud cases through the court system, including Non-Discharge and Objections to Discharge
Evaluate bankruptcy cases to determine collateral market values and file Proofs of Claim with the appropriate court on all asset cases
Maintain knowledge of and ensure compliance with applicable federal and state laws, rules, regulations, and NFCU policies and procedures
Assist with reviewing escalated member issues and determining appropriate resolutions
Perform other duties as assigned
Qualification
Required
Working knowledge of applicable federal and state laws, rules, and regulations
Experience in financial counseling, negotiation, and explaining decisions to members
Experience in financial transaction and processing-related responsibilities
Ability to work independently and collaboratively in a team environment
Experience working with all levels of staff, management, stakeholders, and vendors
Experience interacting with attorneys, courts, or trustees
Ability to comprehend, analyze, interpret, communicate, and apply government and financial industry regulations, principles, practices, and company policies and procedures
Ability to maintain confidentiality and demonstrate integrity
Effective judgment and initiative to make sound decisions
Strong ability to interpret and apply data, guidelines, procedures, and regulations

College-level coursework with a concentration in Accounting, Finance, Business, or a related field
