Responsibilities

Oversee and manage a portfolio of complex General Liability (GL) claims, including habitability issues (e.g., tenant habitability claims, defects impacting occupancy or safety), and construction defect claims (e.g., structural issues, water damage, code violations). Ensure claims are handled in an efficient, fair, and cost-effective manner
Review insurance policies to determine coverage applicability in GL, habitability, and construction defect cases. Analyze policy terms, conditions, exclusions, and endorsements to identify coverage gaps or limitations. Advise internal stakeholders on the appropriate claims strategy based on coverage
Conduct comprehensive investigations into claims, including reviewing incident reports, inspection results, and expert testimonies. Gather necessary documentation (e.g., photographs, engineering reports, tenant complaints) to support claims analysis and resolution
Specialize in managing habitability claims related to issues that impact a tenant's right to a safe and habitable living or working environment. Address claims involving building defects (e.g., mold, plumbing issues, HVAC failure) that pose a risk to tenants' health or safety
Manage claims related to construction defects, such as faulty workmanship, poor materials, structural failures, water intrusion, or other building deficiencies. Work closely with construction experts, contractors, and engineers to assess claims and determine appropriate actions
Lead negotiations with claimants, attorneys, contractors, and other stakeholders to achieve fair and equitable settlements. Focus on minimizing company exposure while ensuring that settlements comply with policy limits and resolve claims efficiently
Provide support for claims that move into litigation, working with external legal counsel, providing case documentation, and participating in the defense strategy. Attend depositions, hearings, and mediation sessions as needed to manage claims through the litigation process
Maintain strong communication with clients, policyholders, contractors, and tenants, managing expectations throughout the claims process. Offer clear explanations of the claims process and resolution options
Identify trends in GL, habitability, and construction defect claims, and provide feedback to senior management to develop proactive risk management strategies. Recommend coverage enhancements or risk-reduction measures to prevent future claims
Ensure all claims handling processes comply with state and federal laws, industry regulations, and company policies. Stay up-to-date on changes in building codes, tenant protection laws, and GL claims regulations, particularly as they relate to habitability and construction defect claims
Ensure accurate record-keeping of all claims, including progress, reserves, and outcomes. Provide regular reports to senior management on claim status, trends, risks, and potential exposure
Serve as an expert resource on complex construction defect, habitability, and GL claims for internal teams, providing training and guidance on handling specialized claims, policy interpretation, and effective claims resolution

Required

Bachelor's degree in Insurance, Risk Management, Construction Management, or a related field (or equivalent work experience)
Minimum of 5-7 years of experience in claims management, with significant expertise in handling General Liability claims, habitability claims, and construction defect claims
Strong understanding of construction processes, common construction defects, and associated liability risks
Expertise in habitability issues, including building code violations, tenant safety, and landlord-tenant law
In-depth knowledge of General Liability insurance policies, their coverage, exclusions, and limits
Proven experience in analyzing insurance policies for coverage under complex claims, particularly with regard to habitability and construction defect issues
Strong understanding of the legal aspects of General Liability and habitability claims, including tenant rights, building codes, landlord liability, and construction defect litigation
Excellent written and verbal communication skills for clear negotiation, claims documentation, and client interactions
Strong negotiation abilities to settle complex claims effectively, balancing client satisfaction and risk management
Ability to analyze detailed construction reports, engineering assessments, and legal documents to evaluate claims and determine liability
Familiarity with claims management systems (e.g., ClaimCenter, Xactware) and proficiency in Microsoft Office Suite (Word, Excel, PowerPoint)

Preferred

Industry certifications such as CPCU, AIC, ARM, or related certifications in construction or legal fields
Experience working in residential, commercial, or multi-family property claims
Expertise in habitability claims related to tenant health and safety (e.g., water damage, mold, asbestos)
Familiarity with construction defect claims in high-exposure areas such as large commercial properties, multi-family housing, and luxury residential buildings
Experience with building code violations and tenant rights law
Ability to work with external consultants, contractors, and engineers in evaluating construction defects
