The State of Tennessee is seeking a DHS Administrative Judge to preside over administrative hearings related to adverse actions taken by the Department of Human Services. This role involves conducting hearings, ensuring due process, issuing findings, and managing case proceedings.

Responsibilities

Conducts telephonic, virtual, or in-person hearings impartially and ensures due process is administered on all cases, while safeguarding the legal rights of all involved parties
Displays judicial temperament and maintains hearing decorum while ensuring all parties understand and follow the procedures of the hearing
Determines the issue(s) to be presented for each hearing
Rules on objections, motions, and admissibility of evidence. Issues subpoenas and administers oaths in preparation for formal hearings
May conduct pre-hearing conferences to resolve issues prior to the hearing. Records and retains all hearings per applicable regulations and rules
Ensures evidence presented during hearings is maintained electronically
Generates a timely and well-written initial order including legally sufficient findings of fact, conclusions of law, and remedy prescribed
Processes and issues responses to petitions for reconsideration of the initial order within the specified time frame
Reviews requests for continuance to ensure good cause is established, and issues orders of continuance
Reviews withdraw requests and generates agreed orders of withdraw
Communicates regularly with administrative clerk and avoids ex parte communication
Conducts legal research of federal and state laws, policies, regulations, and case law

Qualification

Licensed attorney in Tennessee5 years legal experienceTennessee Uniform Administrative Procedures ActLegal research skillsJudicial temperamentHearing decorumCase managementCommunication skills

Required

Licensed to practice law and in good standing in Tennessee, with no prior disciplinary action
5 years minimum experience as a practicing attorney
Proficiency of the Tennessee Uniform Administrative Procedures Act

Familiarity with programs administered by the Department of Human Services
