5+ years expSOTERIA LAW is seeking an experienced California Proposition 65 Enforcement Attorney to lead and support plaintiff-side enforcement actions focused on toxic chemical exposures in consumer products and environmental contexts. The role involves managing enforcement actions, drafting legal documents, and advising on regulatory changes to ensure compliance and corporate accountability.

Responsibilities
Lead and manage Prop 65 enforcement actions from investigation through resolution
Draft and file 60-Day Notices of Violation (NOVs) in compliance with OEHHA and AG requirements
Evaluate chemical exposure risks (e.g., heavy metals, PFAS, BPA, phthalates, acrylamide, lead, cadmium)
Analyze safe harbor levels , exposure calculations, and consumption assumptions
Coordinate with experts and labs on testing protocols (ICP-MS, chain of custody, LOD/LOQ, etc.)
Negotiate and draft Prop 65 settlements , consent judgments, and assurance of voluntary compliance agreements
Handle litigation when matters do not resolve pre-suit, including pleadings, discovery, and motion practice
Identify and vet potential enforcement targets across consumer goods and environmental exposure contexts
Conduct label, website, and advertising reviews for Prop 65 compliance
Assess warning adequacy, placement, language, and online disclosure requirements
Develop evidentiary records sufficient to withstand AG review and defense challenges
Monitor OEHHA updates, regulatory changes, and enforcement trends
Advise on strategic enforcement priorities and emerging chemical risks
Coordinate with co-counsel, NGOs, experts, and internal stakeholders
Support broader consumer-protection and false-advertising strategies where Prop 65 intersects with UCL/FAL/CLRA claims
Qualification
Required
Active California Bar license
5+ years of direct Proposition 65 experience, preferably on the plaintiff/enforcement side
Demonstrated experience drafting and filing 60-Day Notices
Strong working knowledge of: OEHHA regulations
Safe harbor exposure levels
Warning requirements (on-product, shelf tag, online)
Experience negotiating Prop 65 settlements and civil penalties
Excellent legal writing and negotiation skills
Preferred
Experience with laboratory testing and expert coordination
Background in consumer products, food, dietary supplements, cosmetics, or packaging
Familiarity with AG review processes and common defense tactics
Experience layering Prop 65 claims with UCL / FAL / CLRA theories
Comfort working in a fast-moving, entrepreneurial enforcement environment
